This Notice of Privacy and Protection of Personal Data ("Notice") was created to reaffirm MSY Advogados' commitment to protecting the personal data of its clients and visitors, bringing even greater transparency and trust to this relationship, whether through digital means, such as our e-mail address https://www.msydvogados.com.br/, or in person at our physical unit.

This Notice explains in a simple, objective and transparent manner which personal data is collected and processed by MSY Advogados and for what purposes, as well as indicating with whom it may be shared and what resources are available to manage personal data.

The Code of Governance for Fair and Ethical Use of Personal Data and Respect for Privacy of MSY ADVOGADOS and its Operational Policies, the standards and guidelines found in said Code, in particular the LGPD and the regulations and standards published by the ANPD apply to this Notice.

1. PROCESSING OF PERSONAL DATA

We only process the personal data referred to below for as long as is necessary and appropriate for the purposes on which the collection is based, always observing the legal grounds for the processing. Thus, we may keep such data for compliance with a legal or regulatory obligation, the regular exercise of a right, legitimate interest or with your consent. We do not perform automated processing of personal data.

It is not possible for us to identify the user/personal data holder from this information. Cookies can generally be blocked, but in such cases we cannot guarantee the quality of our website navigation.

Furthermore, to comply with the legal obligation of the Marco Civil da Internet - Law nr. 12.965/2014 (art. 15), we collect the date, time and IP of accesses to the site.

Veracity of the data:

Given that the personal data are provided directly by the holder, we assume that they are true and, therefore, we are not responsible for their accuracy, veracity or lack thereof or for their outdating. However, we provide our contacts below, so that the holder can, at any time and free of charge, update or rectify their information.

Data from children and adolescents:

Our content is not directed at children and teenagers. Therefore, we do not age assess or purposely collect personal data from you. Users under the age of 18 should not submit information to us via our platform. If we become aware that we have collected information from an individual under the age of 18, we will disregard the information provided and will not maintain it in our databases.

The Marco Civil da Internet and other legal texts already guarantee that you have clear information about the collection, use, storage and protection of personal data on the internet (article 7, VIII). The LGPD extends these rights (article 18), guaranteeing that the holder of personal data has access to it at any time upon request:

  • Anonymisation, blocking or deletion of data that is unnecessary, excessive or processed in breach of the LGPD;
  • Portability of data to another service or product provider, upon express request, in accordance with the regulations of the national authority, respecting commercial and industrial secrets;
  • Deletion of personal data processed with the consent of the data subject, except in cases of compliance with a legal or regulatory obligation by the controller and study by a research body, ensuring the anonymization of personal data whenever possible;
  • Transfer to a third party, provided that the data processing requirements set out in the LGPD are met, or for the exclusive use of the controller, with no access by a third party, and provided that the data is anonymised;
  • Information from public and private entities with which the controller has made shared use of data;
  • Information about the possibility of not providing consent and the consequences of refusal; and
  • Revocation of consent, by free and facilitated procedure, ratifying the treatments carried out under the protection of the previously expressed consent.

3. SECURITY

The security of your personal data is one of our main concerns. To protect it, we use the technical and organisational measures of information security aiming at the confidentiality and protection of all the data collected or generated in our environments.

The personal data collected through our website are stored securely in our database, in network servers in the cloud especially contracted and separated for the private use of MSY Advogados with reputable and certified providers.

Internally, the personal data collected is accessed only by duly authorized professionals, respecting the principles of proportionality, necessity and relevance to the objectives of our business, as well as the commitment to confidentiality and preservation of your privacy under the terms of this Notice.

However, no platform is completely secure. It is very important that you protect your data from unauthorised access when you are in our online environments and make sure you always click "log out" when you finish browsing on a shared computer. It is also important that you know that we will never send electronic or conventional mail messages requesting confirmation of data or with attachments that can be executed (extensions: .exe, .com, among others) or links for eventual downloads. If you have any concerns or suspicions that your personal data is at risk, for example if someone has had unauthorised access to your personal data, please contact us immediately.

To optimize and improve our communication, when we send an e-mail, we can receive a notification when they are opened, provided that this possibility is available. It is important to be aware that emails are only sent by domains ending with @msyadvogados.com.br

The LGPD sets out a number of situations where the processing of personal data is permitted regardless of the consent of the data subject. This means that in some cases we may collect and process your personal data regardless of your consent (if there is a 'lawful basis' under the LGPD that allows us to do so). In other cases we will ask for your consent to use your personal data.

MSY Advogados currently collects your consent via this page only for processing related to answering direct enquiries, subscribing to our newsletters and participating in our events. If there is any change in the processing of personal data and it becomes necessary to collect your consent, you will be informed so that your consent is duly collected under the terms of the LGPD.

9. GLOSSARY

We know that some of the terms used in this Notice may not be so usual in your day-to-day life. For this reason, we have prepared a short glossary containing their definitions.

Anonymisation: process in which the personal nature of the data is removed and the link between You and the information provided is removed.

ANP or National Data Protection Authority: governmental body responsible for ensuring and supervising compliance with the LGPD.

Cookies: files sent by our server to your computer, mobile phone, tablet or any other device, and which are responsible for collecting access data to our environments, personalising your navigation.

Personal Data: any information relating to a Data Subject, a natural, identified or identifiable person.

Personal Data Controller ("Controller"): Person who oversees and provides support on all matters relating to the processing of personal data, in accordance with the provisions of the LGPD and the organisation's internal policies and procedures on personal data protection.

IP (abbreviation of "Internet Protocol"): It is the set of numbers and letters that identifies the device used to access our website.

LGPD : Law No. 13,709/18, as amended, which provides for the processing of personal data, including in digital media, by natural person or legal entity of public or private law, in order to protect the fundamental rights of freedom and privacy and the free development of the personality of the natural person.

Holder: Natural person to whom the personal data which are the object of the processing relate

Processing: Any operation carried out with personal data, such as those related to collection, production, reception, classification, use, access, reproduction, transmission, distribution, treatment, filing, storage, elimination, evaluation or control of the information, modification, communication, transfer, dissemination or extraction.
